VAL113R Posted March 4, 2005 Posted March 4, 2005 I was driving home from work the other night and approached a Junction. Traffic was parked on double yellow lines both sides and it was difficult to see, but I edged out a little to see better. It was 10pm at night so you could normally see car lights if a car was coming. I edged out a little more and a saxo appeared from now where doing an estimated 80mph in a 30 zone and smashed into the front corner of the car on the passengers side. He hit me that hard that it spun my car 180 degrees. He jumped out of his car shouting sorry sorry are you alright, it was my fault I was going too fast. I called the police who took statements etc. There are 2 witnesses one of which told me his details and said he seen the guy in the saxo tear past him and if I needed to contact him for a witness I could. I went round to the guys house the following day to get his insurance details. His mum said he was out at school but she could give me the insurance details. I asked her if she knew if he was taking liability for the accident and she said she had not spoke to him but didn't think so. I said he was going a bit fast wasn't he. She said well he is not going to admit that is he ? So what do I do now ? I have an appointment with a solicitor tomorrow to seek legal advice. Will the insurance see that he was in the wrong or will they take his side ? Will the police prosecute for his dangerous driving ? When I said to the office that he was doing about 80 he looked at me like I was daft. I said do you not believe me the young lad is driving a Saxo VTS, its a 1.6 16v car. I am sure it is capable of those speeds in a short distance. Also if he wasn't going that fast how did he manage to spin a 1.3 ton car 180 degrees. His answer to that was he hit the heavy side. I would have thought this meant the car would have been harder to move, but the officer didn't think so. Any advice would be appreciated. Here are some picks of the car. Do you think the insurance will write the car off ? If you look closely the roof seems a little bent, where the A-pillar has pulled it down. How much do you think it would cost me to get it fixed ? BTW, activate your PM facility and tell me who has the car. You could get bits off it before the assessors come to see it. (just in case)
Croc Posted March 4, 2005 Posted March 4, 2005 glad you're OK try to get a statement from the other guy who saw the little sh!t going too quickly. solicitor can arrange for this to be taken - but want it asap to avoid confusion and maintain credibility were there any traffic surveylance cameras? - if so try to get them noted before they get wiped - don;t know how long they are kept do you have a note of cars which were badly parked (and breaking the law - cause double yellows are not just 9-5) if all else fails, you know where he lives..... p

VAL113R Posted March 4, 2005 Author Posted March 4, 2005 the car has a custom titanium exhaust from the turbo back if someone wants to swap this for their standard exhaust then they are welcome to it, but you would need to come and change it over tomorrow as I am sure the insurance are wanting to come out as soon as possible ? the car is a 93 wrx let me know cheers
drb5 Posted March 4, 2005 Posted March 4, 2005 Defo a write off bud! Quite possibly got a lot of internal engine damage too! As soon as the pulley's get touched, you can put money on them being bent and the engine would have been at least running for a few seconds after impact. It is also a jig job, which add's a fair bit of dough onto the cost of repair. Unless your minted and wanted to pay for the job yourself, say good bye to it. Just hope your ok, but i'm sure you are.
Big Daz Posted March 4, 2005 Posted March 4, 2005 Car looks gone I am afraid. AFAIK CCTV is kept on file for one month so if it was caught on camera then you should be able to get a copy. Are there any marks on the road that the police took note of to determine the speed of the saxo ? You should be OK on the claim with a witness who can testify that the saxo was speeding / driving recklessly as long as they will listen. He already admitted that he was going to fast but you have to have that proof. Bright side is you will get the boot price from your insurance for the car regardless if your to blame or not. Have you a protected no claims?

Looks like both chassis legs are bent and the nearside one has bent into the pulleys, so there could be engine damage as DRB5 mentioned. Was the engine still running after the crunch, or did you switch it off ? To replace all the damaged panels with new Subaru ones (which the insurance company will use for pricing it) I'm thinking you're talking over £3k + vat. If you add engine damage to that you're taking another £1000+, and then there's labour on top of that. Bad news I'm afraid The main thing is you're still in one piece. The car's only a piece of metal at the end of the day !!! (can't believe I just said that !!) Dave

dave_morgan Posted March 4, 2005 Posted March 4, 2005 I meant to add, if you can't agree a good settlement figure with the insurance company, ask them to throw in the car as part of the settlement. Then sell off all the decent bits to the best bidder (or the complete car as a repairable). By using second hand bits, the repair will obviously be a lot cheaper, and it might be salvageable. You'll need a vehicle inspection certificate after it's complete before it'll go back on the road, but they're not that hard to get by all accounts (if the job is done right). With the right garage you'd probably get it back on the road for 3k ish, possibly less depending on how bad the damage is (and if the engines ok).

scientific steve Posted March 4, 2005 Posted March 4, 2005 sorry to see that some jerk took your motor out dont suppose you took any photos of the crash site ie how the car situated after being hit, where all the parked cars were at the time even car reg no's that were parked there hindsight is always 20/20 but with camera phones the way they are today it is poss. to get pretty good shots even at night, not the first thing you think of just after some di**head has just blasted into your motor the reason i ask is because this has helped out in a suitation before

Crystal indicators and the shiny sti thing under the bonnet. Get them all off before it gets taken away. Just a thought and gets you some pennies back!!!

Funny thing about the insurance though. 2 Months ago I bought an MR2 Turbo and Norwich Union would not give me a new policy on it as it was older than 1993 They don't allow new customers to insure cars older than 1993. What the guy did was transfer my existing policy onto the MR2 which has 4 years protected no claims. The new policy on the Subaru was taken out with a special introductory bonus of 4 years discount. Although I guess that will be lost now. I have seen another Impreza that I am thinking about buying, just trying to convince my mate to drive down with me tomorrow to get it. I bought my girlfriend an 05 plate Mini on the 1st of March and her Corsa is sitting redundant. The garage the Impreza are in are willing to take it as a trade in so thats now too bad. To answer a few questions... I am ok, its just the car thats buggered. I did take some pics with my camera phone but it was a little dark and not sure how they will turn out. Also do digital pics stand up in a court of law ? Not sure how to activate my PM facility (Sponsor this site and don't know how to use it !) Get as many parts of it as you can for your new car (if they will fit) - no point in wasting them - try selling them otherwise. Many folk have standard bits they'd sell cheap or swap you with cash for your better parts... Good luck with the other car - get it checked out though to avoid any re-run of the previous issues. johns Posted March 4, 2005 Posted March 4, 2005 A very similar thing happened to my sister a few yeras ago. Pulling very slowly out of a junction (parked cars either side), this chap came up over the brow of the hill at speed (well in excess of the 30mph limit), couldn't stop in the distance he could see ahead, and skidded into her car. My sister was found to be at fault for pulling out of the junction, despite being the careful and considerate driver Apparently the other vehicle speed doesn't really come into it! The only possible way for the outcome to be different is if you hade been stationary from the time the other car came into view until the time of impact, or the police can successfully charge the other driver with dangerous/reckless driving. Otherwise the best you could hope for would be a knock for knock claim. If you are fully comp, then you'll get your costs covered anyway, though you'll pay for it for the next 5 years in terms of increased insurance premiums Hope it all works out OK for you. John

Good luck with the new scooby , ps, shop around for car insurance, many companies do protected no claims discount which allow you 2 claims per year before taking you back 10 % in your no claims discounted bonus.
