Can any of the in house bobbies clear this one up for me

My work persists in calling me when out on the road. If circumstances allow i pull over and answer it, Nokia brick so no Bluetooth and the handsfree in the van is well guffed, but if i am on the M74 or M8 i dont answer it. They want to know why i wont answer the phone and my answer is it is illegal to answer so i reject the call. IIRC there was a case down south where a company got done for persistantly calling an employee when they knew he was on the road. I would love it if the work got done for annoying the a*** off me at the wrong times

As for all those "whiter than white" members out there, a well known man once said:"let him who is without sin cast the first stone." We've all broken some law/rule/regulation at some point, so don't give the guy a hard time for owning up to his misdemeanor and warning the rest of us to be on our guard. He's not the only scooby owner in the area who has used his mobile phone behind the wheel- I've seen plenty others about doing the exact same thing!

Asked the other half about this a while back as we've got a field based team and i also found this link which was really helpful - http://www.rospa.com/RoadSafety/info/workmobiles.pdf

Page 3 has the paragraph "Employers who require staff to use any mobile phone while driving for work could be prosecuted if an investigation determined that such use of the phone contributed to a crash. Claims in the civil courts could also result."

Because of this we tell all of our employees to turn their phones off while in the car. We also get them to sign on their expenses every month that they understand we don't expect them to make or receive work telephone calls while driving etc etc

There has been a stated case through the court system whereby an employer made constant and persistent calls to his employee. The employee argued in court but still lost and was given 3 points and £60 fine, however, the court stated that the employer has a DUTY OF CARE under the health and safety guidelines to either not call if their staff are driving, or provide a hands free kit and a suitable phone to enable them to take the call. If they don't, they are leaving themselves open to a civil case, as described above.

Spotted it today as well, ironically in a petrol station (Esso near Ibrox).. Was going to get some banter with the guy but i was washing my car at the time.. Nice looking car, black 57-plate.. I didn't think any were coming here in Black?? <_<

I had it out with my last boss a few times about the same sort of thing (Small company though) Kept getting on at me for never picking up the phone when they need to contact me.. I kept tellin him if he wants me to answer my phone on the go it's up to the company to provide a phone and handfree kit which I can use.. They never did... SO I never answered there calls.. Although you'll easy find him driving aroudn the area at great speed with a mobile phone in one hand and no seatbelt and a heavy foot over the brake pedal! (scary!)

Fortuantely don't work there any more... moved onto better things <_<

Oh and nice to see the Traffic polics have good taste! The challenge has gotta be to get a photo of it without getting nicked! LOL! There'a couple of imprezas in teh road safety unit up this way but their rarely used AFAICT.

I'm afraid his vehicle is rather larger than a scooby and floats mate. judging by the post time i'd say he was rather sloshed at the wheel as well lol

spotted the black unmarked sti bl57uop coming out of the bp petrol station on carlisle road

airdrie at 5.20pm.note this was after spotting two more marked traffic cars one on black street

and one on motherwell street(also airdrie). at first just thought it was another scooby gave wave

never got returned the he had the cheeck to overtake after flashing the blues

What gets my goat is that it's illegal to have a phone conversation, but it's ok for the cops to use their radios! Some will say that the passenger does the talking, How about in England where there is only one in a car? If I am right (probably not :lol: ) it's not the dialling that causes lack of concentration, its supposed to be the conversation. Will it soon be illegal to chat with a passenger?

Never mind the Polis using radios...I passed one texting driving down the A1 today..

I was going to point it out to him but somehow I don't think he would have seen the funny side of it.. :)

Think G is on nights... same as me... But they wont let me drive this one... :thumbup: unless he's home again...?

That just makes it worse though... On the phone at the wheel... at night... whilst working... shocking... :)
