IIRC (and I may be wrong) but as I understood it, a claim against a non-discharged bankrupt can be made up until the point of discharge (I think this is about 2yrs these days - particularly for personal insolvency). That said, if you were able to submit a claim, you would be at the back of the queue.
You know you can check if he has definitely gone bankrupt don't you - just swing past any county court (or the Scottish equivalent) and they can point you in the direction of his appointed Official Receiver or an insolvency practitioner.
