david_taylor Posted July 13, 2007 Posted July 13, 2007 Well, after 12 years of incident free driving I was caught speeding on the M80 Stepps by pass today. Was daydreaming and caught doing 90. Thing is the motorway limit there is 50. They were sitting on a slip road and timed me to get the speed. I know its wrong, so will take the penalty on the chin. As its 40 mph over the limit they have to refer it to the fiscal for consideration. The coppers said the procurator could change it to wreckless driving. To be fair the cops said the road was clear and as I was not weaving in and out of traffic they did not consider it dangerous or wreckless. Anyone have any idea of the outcome? Cops said they might still decide on fixed penalty, but I doubt it. I am expecting the 6 points and a fine, of which I have no idea. Plus what do you think that will add to insurance policy? Needless to say, think I will be sticking to the law now! Ashamed Dave

Same thing happened to me 5 years ago at the same spot - though it was 10:30pm at night and I didn't realise it was a 50 so when the police car was behind me I accelerated to get past a car and, in my mind, let the police through - but no, they were tailgating me and stuck with me when I pulled over and on came the lights. Thankfully I was only doing 64 - so only got the 3 points and fixed fine. I think you're right, 6 points and a fine. Not sure what it will add to the insurance, possibly not that much given that speeding points are so common these days. Best of luck though. Richard.
david_taylor Posted July 13, 2007 Author Posted July 13, 2007 They were quite coy. Said that I was just over the limit for a fixed penalty. The cop who was pretty friendly is doing the report and it was him who said that he thought I was not being dangerous. Said its totally the fiscals decision.

I always thought 30 mph above the limit was a form of ban except in exceptional circumstances. Having 5 points made a significant difference to my premium for a number of years.

Was that on a Motorway Alan? The cops seemed to think that the fiscal might just go for the 3 points due to the road conditions. Do you need a lawyer for a summons? My mate was caught doing 106 on M74 and got a two week ban.

[] I got banned for 103 in a 70... 33mph over the limit, on an empty motorway in the middle of nowhere with perfect driving conditions and the traffic coppers were also nice and said that it wasnt wreckless/dangerous and that it was just too much for a fixed penalty. I'll be very surprised if you get away without a ban for 40mph over the limit in a 50mph section of road buddy. Cheers, Grant

The cop made it clear unless the court seen it as dangerous driving then its 6 points max, but as the road was dead when they done me then the fiscal should not go down that road.

My mate was caught doing 106 on M74 and got a two week ban. Yes it was on the motorway, not far away from where you were stopped. Was a 50mph limit and late at night. Depends on the severity of the offence, sometimes you can just plead guilty and they'll let you know the outcome (what i think may happen in your case), or they may request you *have* to attend , in which case you're better off with legal representation.

Already accepted whatever happens anyway. Checked a few legal sites and they all indicate a 6 point penalty in Scotland and a 2 week ban in England.

Yeah Mark you are right. On hind sight its only after the Bishopbriggs slip roads folk are pulled. They must sit just right to do your timing when spotted! In hind sight folk....beware.

Unfortunately Dave, luck aint on your side. Wallet out - and laminate your License before you have to pass it to the polis etc. (for van hire etc)

Was done couple weeks back for 93 in a 70 (Dual Carriageway). Again no other traffic and clear road. Got given fixed penalty 3 points and 60 quid. strangely enough I've noticed me getting more miles out the last 2 tanks of fuel. best of luck with the procurator fiscal mate. hope for the best but prepare for the worst.

craig_harey Posted July 14, 2007 Posted July 14, 2007 hi m8 i got cought in my jeep doing 86 in a 60 on a friday night late on heading home to campbeltown last year i had clean licence was reported to fiscal had letters saying i was self employed and worked all over scotland and licence was essential part of buisness my uncle was taffic cop told me lucky if i get 5 points what did i get a 4mth ban £150 fine could not believe it then i was working in dunoon and was readin local news paper and people were getting cought at 93 in 60 and got 6 pont s it the luck of the draw my sherrif son was killed by drunk driver so hates any thing to do with car offenes cops told me its dry no other cars on road that will go in your favour but it never even got cosidered Craig
