You should be ok in getting the recordings from the calls mate, most call centes archive them away every 3 months or so but keep them for 2 years to comply with ofcom recomendations.I have never had it happen with the Call Centre I work at but you can probably request a copy of the call recordings for yourself so that you can listen to them incase they claim you did.

you never know though, by your insurer paying out against your will you may well have a chance of claim against them which they will most probably want to sweep under the carpet rather than deal with.

I have heard legally she does not need to contact you,if she is fully comp her car is automaticly repaired leaving the insurance company to reclaim their losses. Your only legal grounds after rearending are to prove dangerous driving on her part very hard to prove even with a witness.And practicly impossible with the timescale personaly i would pay the excess.

 yeah, but on a hill, she rolled back into me cos her clutch control is shite[:D], then its a different story, been advised by the police n i do have a case here, time to fight it. i aimt paying a penny.

Bad news m8,

the advice from my missus, insurance underwriter, is that the person you crashed into had every right to notify her insurance company and they are within their rights to fix the damage and claim from your insurance company. Usually the insurance companies will sort out / agree who is liable but in your case it is a fairly easy decision.

Was gonnas post a new topic for my Insurance q but thought I would add it on here - my dad's car was writen of at the weekend by a neighbour who has admited to driving too fast on the ice and has signed a letter (at the scene) to that effect.

Insurance company has said they will only pay market value of the car which sucks as it is a Rover 75 - my dad is a bit upset as he paid 12K (for a 15K car) only 3 yrs ago and was going to keep it for another 3 yrs as the car has only 20K - now cause of someone else he is stuck with no car and having to get a replacement for 4.5K (if he is lucky)

Is there anything he can do? 

Also other aspects such as teh private plates, the transfer of said, the CD Changer he paid extra for etc are also not mentioned by the insurance co.
