st3ph3n Posted March 8, 2006 Posted March 8, 2006 Letter in from Dumfries today. 92 in a 70 on the A74(M) at Kirkpatrick on Saturday morning. D'OH! What are we talking about fine wise then? Knew I'd got close to that one as the RA hadn't beeped and had set the tomtom warnings too short.
st3ph3n Posted March 8, 2006 Author Posted March 8, 2006 Cheers Cal. First time since I passed my test in '98. Not bad for someone with a weighty right foot like myself.
bigbadboab Posted March 8, 2006 Posted March 8, 2006 3 pts and £60 from my experience Yep, I concur captain[:|]
oz *sti* Posted March 8, 2006 Posted March 8, 2006 Not good mate, I would say the same you prob will get a SP30 with 3 points on your licence with a £60 fixed penalty fine. []
bigbadboab Posted March 8, 2006 Posted March 8, 2006 Cheers Cal. First time since I passed my test in '98. Not bad for someone with a weighty right foot like myself. I've never had a clean license since the first day on the road on my Yamaha 125 scrambler, aged 17, now 38......opps. Funnily enough, it would be clean TODAY but that costs money[]
st3ph3n Posted March 8, 2006 Author Posted March 8, 2006 Och it's a fair cop. I was doing it, I'll take my medicine. Just hope none of the other ones got me.
RA Dunk Posted March 8, 2006 Posted March 8, 2006 i got stopped doing 89 in a 60 about 3 or 4 months ago by an unmarked cop car , still havent heard nowt yet how long can it take before you cant get prosecuted??
john mac Posted March 8, 2006 Posted March 8, 2006 Admit to nothing,MAKE THEM PROVE IT(the scamming gits)[:@],this is what they rely on, decent people putting their hands up and coughing up without question. Its a well known fact that these cameras are inaccurate........get yourself over to www.pepipoo.com (fightback forums) for some top advice. I got off with 81 in a 70 last year thanks to that site ,they tell you how to deal with it step by step!
oobster Posted March 8, 2006 Posted March 8, 2006 Not bad for 8 years driving st3ph3n. Bound to be worth a wee bit of research to see if there are any loopholes, but i tend to favour the pragmatic view your taking.
st3ph3n Posted March 8, 2006 Author Posted March 8, 2006 I don't see anyway to get off with it to be honest. The NIP is all correct and they'll have the camera evidence I imagine. No point fannying about with them and risking a court apperance when I can get the basic 3 and 60.
FastScooby Posted March 8, 2006 Posted March 8, 2006 ask to see the photo... i am going up to contest me doing ahem mph in a 30... been in court 3 times now and put back again til may... seemingly there is a thing regarding the camera.. they are not allowed to use the radio because of the inaccuracies... i would try leave it as long as possible to the 28th day then ask for the photo... if it comes back and it is you fair enough.. or consult your lawyer [:S]
st3ph3n Posted March 8, 2006 Author Posted March 8, 2006 I'll write back telling them it was me. Front facing camera from overpass with just me in the car. Not going to be able to contest that. I'll see what they come back with in terms of a fixed penalty or whatever before deciding on a course of action. I'm a great believer in doing the time if I've done the crime, so 3 and 60 is fair game.
john mac Posted March 8, 2006 Posted March 8, 2006 I waited the 28 days then asked for the photo, still wasn't sure who was driving[]...,then waited another 28 days to tell them this.NIP came back again,i sent it back unsigned after another 28 days ,the local police came round and threatened me with a section s172 failure to supply details[:'(],so i said it was me that was driving as this is a seperate offence and didn't want that,so i then got the offer of a fixed penalty....I ignored this and waited on my day in court which never came as my case timed out...[]....The first diet has to be read out in court within 6 months of the offence taking place. P.S dont be frightened of going to court because even if you lose they wont increase the points, they will only increase the fine to about £100 and they cant award costs either way in Scotland!! Just remember those point are on for a long time ,let them prove it was you in the car!!
SergeantScooby Posted March 8, 2006 Posted March 8, 2006 acid i concur with col, you cant be done 6 months after the incident
~ ~ Cal ~~ Posted March 8, 2006 Posted March 8, 2006 I have been there before - take the hit, 3 points initially did NOT affect my premium. £60 is a night on the p1ss. You can forget about it within 24 hrs and get back to chilling like a villain. When you hit 6 points start challenging them. They caught you fair and square by the sounds of it so don't put yourself through the grief. 9 points will double your premium and 6 will add circa £150 - £200 CGS
Baz81 Posted March 8, 2006 Posted March 8, 2006 St3ph3n providing that you got a fixed notice through the door and not a letter from the courts it should be an open and closed case of of 3 brownie and -60 sheets from your bank balance. I've read in the book published by a ex Traffic cop that if you send them a chq for £61 pound they would need to credit you a pound and as long you don't cash it the paperwork is not complete which means that they can not issue the points. Not sure if yu send off you licence at the same time though for that to work? I've always ended up in court for my club foot offences [sn]
vicki Posted March 8, 2006 Posted March 8, 2006 Nightmare Stephen. I would go for the easier option and pay the fine and accept the points. Just try not to get any more.
st3ph3n Posted March 9, 2006 Author Posted March 9, 2006 Yes. It's the wise thing to do I think. I don't think I've been hit by anymore. Not sure what the range on a van is, but I'm sure I missed the rest, and I was slowed down for the SPECs in the roadworks nearer Preston. I've worked out if I'd just slowed down a bit in the first place a wee bit I would have actually got where I was going just as fast as I wouldn't have run out of petrol so quickly and had to stop. 400 miles = £80. Not good considering all but 10 miles of it was motorway.
oletam Posted March 9, 2006 Posted March 9, 2006 I don't see anyway to get off with it to be honest. The NIP is all correct and they'll have the camera evidence I imagine. No point fannying about with them and risking a court apperance when I can get the basic 3 and 60. I agree! If it was you why go through the hassle/expense of various court appearances to end up with a higher fine. The range on the camera van by the way is about 3/4 mile.
st3ph3n Posted March 9, 2006 Author Posted March 9, 2006 Really. I'm sweating a bit now as I didn't think it was anywhere near that.
neilswrx Posted March 9, 2006 Posted March 9, 2006 dis agree with the £61 trick as all they,ll do is post your cheque back with a nasty note know a few who tried and failed 3 and 60 anit too bad if its your first 6 points good to argue with was your detector calibrated officer(er no hahahhaha see ya)
