RS Grant Posted March 2, 2005 Posted March 2, 2005 A friend has recently been caught by a Talivan at 101mph in a 60mph zone. It was on the A92 Dundee -> Kirkcaldy Road, he was travelling BACK from Kirkcaldy when he drove past the front of the van and away from the rear of the van....... He (and I) were under the impression that you couldnt be done as they dont have a photo of your face driving the car?! The reason he was doing that speed was that he had pulled out to overtake a van, car and a truck. He had accelarated hard up from around 50mph to get past them. He uses the same technique as me, keep it planted until you are past the obstacle as it reduces the time exposed to danger.... once back in your own lane, drop to sensible speed again. He has recently got a Sales Rep job, and also drives on Saturdays for a Car Hire Company so his license is extremely important to him.. He's really worried that he'll get banned and a huge fine for this, meaning he'll be un-employed and unable to pay his bills. I told him that it didnt look too good.......... Does anyone know if there are any VERY good Solicitors within a 100mile radius of Dundee who specialise in Motoring Convictions?? I wasnt putting the $hits up him for no reason was I, he's looking at a lengthly ban and fine minimum surely?? Cheers, Grant
imprezapete Posted March 2, 2005 Posted March 2, 2005 The Scottish Law used to be against front shots from Gatsos due to the white flash, but the law was changed in the last few years to allow another flash based detector to catch speeders. Gatsos shots that are coming into the camera flash aren't still allowed if a white based flash, I asked that of a friends traffic cop brother. Privacy laws were also a reason as to why you couldn't done from the front, but the law was also changed. I got that from a friend in the Tranport dept in The Scottish Executive. Hes a good source of info as I trust him, as know this as I for the Scottish Executive. Ok the only advice I can give you from others I have seen is to: 1. Its a Court case, dress very smart 2. Plead guilty, no point trying to get around this. Your m8 was nabbed fair and square. 3. Get his lawyer to build a case as to why he shouldn't loss his License due to family, Job and financial commitments. 4. Dont try to get around it as judges take dim view of this, if he shows thats hes sorry and not going to do it again the judge may take this as a one off. 5. Hope he has a clean license to help his case, if he has points or run ins with the law the judge may not be nice in his ban and fine. Hope this helps m8, but hes got a good chance of getting some length of a ban.
drb5 Posted March 2, 2005 Posted March 2, 2005 Personnaly, i got a ban a rather hefty fine for doing pretty much the same and they don't have to get a pic of yer ugly mug to convict you neither. They'll just simply give tyhe ban/fine to the person who own's the car. Hope that helps.
