Why take it out on us when your grievance obviously lies with T&C?

Can you not take our word that potentially libellous comments CANNOT be posted on this or any other bbs?

It would be unfortunate if you decided to leave the club. This is just one of those grey areas that we all have to live with.

<< Within reason However as a resonponsible club we should not allow libellous posts to be made >>

Point taken Phil.

I suppose then that unless someone can substantiate their grievance with either Dealer,Manufacturer or Supplier then they should just put it down to experience & move on.

Alternatively there are ANGER MANAGEMENT courses availableface-icon-small-happy.gifface-icon-small-wink.gif

The situation here is quite clear, and there is no need to rant.

The opinions stated in any individual's post are clearly those of the individual. The club, however, publishes those opinions on the forums. As a publisher we still have a duty of care with respect to the content of our publications - i.e. this forum.

If the author of the opinions will not withdraw them, and the publisher takes no action to remove them, then the operator of the website (i.e. our hosting partners) could ultimately be asked to shut down the site completely. This can be legally enforced and there are plenty examples of situations where websites have been shut down because of material that was hosted on them but hadn't been put there by the operator or publisher of the website.

In general the club approaches this duty pragmatically. I'm glad to observe that 99% of the time the posts on our forum do not cause problems. I'd like to see this trend continue.

For the occasional posts that do cause offence or raise concern, then as the publisher of that material we must act in the best interests of the club as a whole. Accordingly we may, on those very rare occasions, edit posts or remove threads. Your acceptance of this forms part of the

Terms and Conditions for the use of the SIDC Forums - to which we all agreed, as part of the signup procedure.

Your continuing support and cooperation, to ensure that we can continue to be pragmatic about how we approach this issue, is greatly appreciated.

well what is the point in the disclaimer???

Posted

No, it's not a waste of time. I repeat: It's your agreement that your comments are your own and not those of the club. If the disclaimer were not in place then it might be inferred that your comments and opinions were those of the club. As it stands, the club is expressly separated from your comments and opinions.

It does not however remove from the club its duty of care as the publisher of your comments.

Gordon,

I can see where you are coming from. You pay a subscription to a club and feel you should be able to express your views. You are totally correct, you should be able to but unfortunately in this stupid world we live in, Subaru / T & C / Whoever could have their lawers on it and it will all fall back on the club not you. I appriciate that you are saying these are your views but the SIDC are publicising it. Maybe if something did happen regarding your comments (of which ive never seen) was to go to court for slanderous comments, they may be able to argue that they were your views, not theirs but lets be honest, who wants that hassle!! If you were in the sidcs shoes would you? I have had terrible dealing s with T & C also, probably same as you, having a Subaru at 20, but I express my views about them to people in public, not on BBS's. I hope you get everything sorted out. The SIDC will help you all they can but you cant expect them to put their ass on the line over one users problem with a company. Please note I am not having a go at you, just offering an outsiders point of view.

What about linking to a webpage not hosted by the SIDC containing a grievance?

I've had a run in with the same dealer and would be happy to contribute to a page of 'experiences'.
