Was wondering why on earth a Ford Focus was driving it's wee heart out to keep up with me. Turned out he wasn't interested in racing me, but charging me! Yip, was the cops in an unmarked black Focus. Stopped at a busy junction at the end of the Cathkin Braes road allowing him to finally catch me. Imagine my horror when I looked in the RVM and saw the nice gentleman approach me from the rear. Just regular cops with a regualr car so can't do me for speeding undless they get their speedo calibrated to prove my speed. Reported for dangerous or careless driving (or both, can't reember what he called it section C or something!!). Chaps were nice enough complimtented the car etc. said the PF may not pursue it. So, any idea what I might get for this? Think the PF will pursue it?

It was probabily Section 3 RTA 1988, careless driving. Depends on what the circumstances of the incident were, how busy the road was, road conditions exactly how were your driving etc. To be honest it's now just a waiting game until you get the dreaded letter through the door.

To prove a charge of Dangerous/Careless driving you don't need to prove a speed, you just need to prove (In this case the two cops speaking to it) that the manner of driving was below what is expected of a safe level. It's different from proving a speeding charge

Yeah, I have no quams about the "charge", just lucky he didn't have a radar, otherwise it would have been much worse. What is he points/fine that goes with that Section what-ever-it-is thing? Do insurance companies frown upon this more that SP30s etc?

The maximum penalties (and this is maximum, not probable) for Careless driving is £2500 fine, and between 3-9 points. Dangerous driving is a bit more extreme, the max for dangerous driving (and again this is the Maximum allowed by law) is 2 years in prison, an unlimited fine and an obligatory ban. When you get your licence back after the ban for Dangerous driving, you must sit an extended retest.

Like a say mate theese are the maximum allowed in the courts, and would only be applied to the most extreme cases of each. Again, depending on the circumstances of the situation you may get a small fine and some points, but like a say bud there are so many factors involved. As for your insurance im not totally sure, they would consider it more of a risk than an SP30, however again just depends on the circumstances.

I am really not trying to scare you bud (and hope I am not!!) just giving you the facts

Try not to worry about it mate, sounds as though the cops you spoke to were fair with you, and you with them so that will go in your favour too. Best of luck with it bud, hope it goes well for you

I reacon that the full livery on your car grabbed their attension,because i was heading home from work on tues night when i found myself in front of a uk300 livered up, pulled in to the slow lane then back out to watch his progress,btw it was on the dual carriage way headiing from grangemouth towards glasgow/perth.Just before the cut off for glas the uk300 driver decides to under cut the idiots in the outside lane i start clapping my hands in my little derv astra TD.AV got a Q.What would happen to a yellow canery if you let it out in the wild,BIG BAD CRAW

I have been led to believe that with a good lawer, and the fact that there is no video evidence, then it is not that hard to get off.

My friend got caught in the same circumstances about 4 years ago.  He got a letter through and pled not guilty.  Never heard anything again.

Looks like the PF hope you plead guilty and take the fine and points.  If not they dont bother.  Probably due to the potentail court cost and loss if its not proven.

Sounds like you passed the "attitude test". Cops, unlike scameras, have discretion and the "attitude test" is well known. I know of someone who failed the attitude test and was smug as f*** as he was in a newish car so thought when they started their walk-around he was in the clear - working lights, plenty tyre tread etc. They did him for no fluid in his washers...

Again though dtabbit77, it just depends on the circumstances, the courts may have accepted his not guilty plea as there may not have been enough of a case to prove the charge, but not knowing the full circumstances in this case it's hard to say. End of the day the fact there is no video evidence does not matter, there are two Police officers speaking to a set of circumstances, manner of driving etc, so it is no different than say two Police officers speaking to someone assaulting someone else, video evidence is hardly ever used in cases of Dangerous/Careless driving, unless it's a Traffic car that has stopped you and is fitted with video equipment. It's just down to whether the Sherrif / JP believes the Cops or the driver.
