My Cars Been Injured

my car has been hit by a woman in a Suzuki alto of all cars.the stupid woman was not paying attention and pulled out from a junction and strait into the side of me after the initial thoughts of aahhh im going to kill her i went over to make sure sure she was okay.as this happened at the junction to my street and she lived round the corner we both took our cars home then i went round to her house to exchange details,where everything seemed fine and she was in acceptance that the accident was her fault,until i get a letter from her insurance companies lawyer informing me that she was claiming the accident was my fault and the two passengers that were in her car were here witnesses,i also get the impression from the letter that they are also claiming damages but she had nobody in the car at all.which has left me no alternative to go round all the neighbours houses to see if i can get any witnesses,luckely i have found one who did not see the crash but did hear it and went strait to his window and can back me up that there was nobody else in her car.

and to add even more insult she posted a letter through my door offering £300 not to go through the insurance.

and after just having it resprayed too :(

ahhh gutted for ya stevie :( as you said just sprayed.

keep a hold off the letter she put through ya letterbox and let you insurence know. surely offering you £300 not to go through insurance then puting a clame in saying its your fault is fraud. might even be worth speeking to the police and let them know whats she trying.

Agree with jodie tell her you are getting the police involved and that you have a witness that will say she had nobody in the car with her, what she is trying to do is fraud.

Yep, keep her letter and inform your insurance company, I would also have a word with your local police station and your insurance company regarding her making up 2 witnesses in her vehicle as this is indeed fraud.

Have heard of this type of situation happening down south where drivers invent other passengers who then have injuries to get a compensation payout, so well worth involving the authorities over this one.

Agree inform your insurance company and the police.

I had a similar situation a few years back. The wife reversed out of a friends drive and knocked over a motorbike which was parked across the street. Totally her fault but the guy comes out of the house effing and blinding etc. He then tries to pick the bike up and promptly drops it on the other side damaging the fairing handle bars etc on the side which was not damaged. He then tells his insurance company that all the damage was from the impact.

Unfortunately for him I had 4 witnesses that seen the incident and in the end my insurance paid for the damage to one side and he had to pay for the other side. The best bit is I knew the guy and ripped the piss constantly as he was an a+++ anyway.

Sorry to hear this I had a guy reverse into my front wing, thankfully it was before it went for a respray and he paid cash for the cost of a new wing. Plus a bit extra for my trouble :(;) . A few years ago my mum, who worked for a insurance broker, commented about fleet insurance companies providing accident packup's. This included a one use camera that is sent away for processing. I bought one and keep it in the car so that way if someone hits me I can take pictures for reference. Also my phone has a built in camera so I can use that and show the other person the evidence I have.

just got off the phone with the solicitor and found out that they are defiantly claiming for injuries.so im off to have a word with the local plods

stevie get you witness to right you a couple off lines on a bit paper telling what he saw and take it to the cop shop aswell....even better iff he/she was willing to go down with ya :(

tell the police where she lives (as u will anyway) take a picture of your car and hers, the police should take notes after viewing both damaged cars. they will be able to see how conatct was made between the cars. the she will be bang to rights mate.

Had experience in this kinda job b4 so pretty much sure she'll be up the creek without a paddle mate.

Hang tough mate and don't let any of them change what u say.

Gutted mate know how you feel! as when on my way home from the colin mcrae tribute run yesterday some prize PRAT bumped in to the back of me on the motorway, just by luck he was harldy moving but hit hard enough to bend my exhaust and bumper! not a happy camper as i only painted bumpers few weeks ago. :(

went to see the local policeand they turned out to pretty helpful(i think it helped that my local station is the airport and that is where i work) after explaining what was happening they took a statement from me. the police are in total agreement that she is at fault and have even went so far as to give me a producer after i told them i heard she might not have a full licence so they can do the same to her.they have also recorded her as vehicle 1 (which basically means she was at fault) as she should have stopped at the junction to give way.

i will be phoning the solicitor in the morning with all this information to see what they say.but with all this on my side hopefully i should have no problems.
