Legal Advice Required .............................................................................

Folks

I need legal advice regarding my alloys wheels.face-icon-small-sad.gif

I took them to an "Alloy Wheel Specialist" to get them refurbished/polished/diamond cut as they were a bit shabby and needed a refurb. The guy I spoke to said, "No problem, it'll take 3 days." I was actually quite impressed with that so I left my alloys with him. So far, so good.

It then started to turn bad when w he wanted £200 up front before taking the alloys in. I argued that I can't pay someone for something they haven't done yet so it came to a compromise that i gave him £100 and then another £100 when it's completed. So that was agreed and I got a receipt for my £100 and the alloys.

That was about 1 month ago now and I still haven't got my alloys back. He kept saying that he's got problems getting them to "shine" and turn out the way I wanted them to. He then started saying that it'll be "next a couple of days". That's about 3 or 4 "couple of days" I've heard from him. He even said he'll phone me backwhich he never has.

I've had enough and want my alloys back, no matter what condition they are in. How do I go about it? What legal rights do I have? What about the initial £100?

Any advice would be greatly appreciated.

baseball bat and some mates would work for me???

have you contacted trading standards???

althou the first option is usually quicker

I would do the following :-

1) visit him amicable in person to ascertain whats going on

2) threathen to slate him on every forum / msg board known to man and let him know that it would potentially cripple him

3) threaten ( at this stage ) legal action but son't do anything yet

4) get a win-win i.e get wheels back plus compensation cash but let him feel as if he's go off lightly with messing your around

5) BUT if the wheels are goosed then we'll have an SIDC meet at his workshop and persuade him to comply

Good luck and stay calm - he may be a loose cannon with financial difficulties, stress etc = time bomb if wound up by Scooby lover

p.s dod you have something in writing on what he would do to the wheels ? quote or something with description ?

Thats a bummer Gordon, good luck in sorting out the situation.

ps when the "wife" is in this sort of situation she always starts with citizens advice, (on speed dial in the houseface-icon-small-wink.gif) Worth a phonecall.

Thanks for the advice guys, your opinions are greatly appreciated.

I thought about Trading Standards and Citizens Advice but they're closed Saturdays aren't they? Suppose I can wait till Monday. Putting them on SpeedDial will remind me!face-icon-small-wink.gif

I don't really want to slate this guy yet as he might be underpressure as he's just opened his place and it's relatively new. That's why I'd thought to give him a chance first before doing anything. His place is based in Paisley so I think a lot of you will know by now who I'm talking about.

I thought about going up to his place today and demand to take the wheels back, no matter what condition they are in and take them to somewhere I can really trust. And that's why I've posted this thread up.

Can I just turn up and demand my own alloys back? And get away with my deposit back? It sounds a strange question but I'm no lawyer and I don't really know my rights. I'd rather get my facts right first before going up there.
