BLUE V LTD Posted February 14, 2008 Posted February 14, 2008 Hello all. Needed some advice or what would you do if in this situation. I bought a TD05 High flow turbo second hand off Scoobynet in the new year. When i took it out of the parcel it was covered in dirt and normal under the bonnet gunk, it also still had the up pipe connceted to it. Well with one thing and another i started to clean and try to remove the up pipe about a week or so ago ready for new gaskets and to be fitted by Deano. After soaking the turbo in some degreaser for 24 hours and not having much luck getting the pipe off, i gave it to deano to see if he could have any joy over the weekend. Well on the tuesday i got a phone call saying the pipe was off but the bad news is the turbo has about 6 cracks in it and only fitt for the bin.... I've emailed the person i bought it from with the bad news asking for a refund as it is no good to be fitted. I got a reply the next day saying alone the lines of "it was ok when it came of my car not smoking bearngs where fine can't see how its fitt for the bin sorry can't refund the money". What do i do? shall i try fitting it and see what happens ( not to keen on this opition cracks can only get worse) Bin it and cut my loses. I did pay for it through paypal am i covered in any way for being sold faulty goods Can i get it tested to see if it is ok under pressure. Any advice would be helpful.
tony_cousins Posted February 14, 2008 Posted February 14, 2008 Would not fit it Matt, will only cause more agro and maybe harm the engine and you dont want to end up replacing another unit !!!!!!! Shame there are so many scammers out there, but in all honesty the chap may not have known and in his good luck saved himself from an expensive repair bill !!!! Tony

I would not even consider fitting the turbo if Dean has already condemned it, the last thing you want is for it to blow and all that oil burning through your engine. Because you paid using Paypal you do have some form of redress. If your account is serviced by a credit card the card company will cover any cost of the item. But first you must write to the seller stating that the item is not fit for the purpose and (clearly) ask for a full refund, this will establish that he sold you the item and give you a recorded formal response. At the same time ( tomorrow ) file a dispute action to Paypal outlining your problem. Paypal can freeze payments under special circumstances if it's not to late ie he's closed the account. I would suspect that you only paid about £250-350 for the turbo so you can take the seller to the small claims court which is really easy to do and a lot of hassle for the sell if he lives a long way away. You will need write evidence confirming that the turbo is unuseable and therefore not fit for it's purpose. So all is not lost

wedmonds1 Posted February 15, 2008 Posted February 15, 2008 Nightmare... Sorry to hear that. You could ask them if they would be prepared to pay half or something and at least you could have some damage limitation. You could also tell them that they are welcome to see it themselves.

How much was you looking for dazzler Plus would you part ex for mine ( lol ). For the amount i paid for it might just cut my loses and learn from my mistakes. I still have the turbo and have offered to show the seller how bad it is.
20withascooby Posted February 15, 2008 Posted February 15, 2008 ID OPEN UP A DISPUTE ON PAYPAL THEY ARE USUALLY GOOD WITH THINGS LIKE THAT I ALWAYS SEEM TO WIN CASES JUST MAKE SURE THAT U EXPLAIN EVERYTHING FULLY IN THE DISPUTE TO THEM ABOUT CRACKS AND NOT BEING TOLD AND WHAT HE SAID THE CONDITION WAS WHEN HE SOLD IT TO YOU WAT HIS REPLY WS TO YOU BLA BLA BLA AND THEY WILL DECIDE WEATHER TO GIVE U A REFUND WEATHER HE LIKES IT OR NOT IF THE DECIDE IN UR FAVOUR THEY TAKE MONEY OUT OF HIS BANK WEATHER HES GOT THE FUNDS OR NOT
